if two 21 year old males get assaulted at a drunken party, then one who is gay, Arab, etc has an attacker who goes to prison, and the one who is not in a special group has an attacker who spends a few nights in Jail. As long as the district attorney believes that part of reason for the attack was because the attacker had some negative thought about that particular group, for example they said something on that night or a previous time that may have been construed as racist.

This, what you are talking about, can be considered as thought crime legislation. And, along with such crimes go much stiffer penalties. This sounds like something out of the book 1984 cuz the perpetrator is being penalized, not only for the act, but for the thoughts he/she may have had while they committed the act. America is becoming a much crazier place to live:(
